Patrick Waterhouse’s new book is a welcome addition to my shelf in the office dedicated to all things NEC.
The book takes the reader through the compensation event process set out in section 6 of the Engineering and Construction Contract Conditions, starting with an explanation of what the various types of compensation events, that any user of the NEC forms will be likely to encounter. Having thoroughly explained the compensation event process, Mr Waterhouse’s book then moves on to explain the role played by defined cost in both the priced and cost reimbursable versions of the ECC.
Defined cost is used in the ECC to establish either, the amount to be paid in respect of a compensation event or the price for work done to date, depending on the ECC option chosen.
This book demystifies both the use of the schedule of cost components and the shorter schedule of cost components in establishing the defined cost.
The book is all about practical application of the ECC, it does not get bogged down in legal theory or case law and will be of use to both practitioners like myself and students alike.
